Custody and Child Support Modification
Why Get a Modification?
After a marital dissolution or child support
decree is finalized, parents often need or want
to have aspects of the decree modified to
reflect changes in circumstances. In the
following situations, a modification may be
necessary:
-
One parent plans to move out of state
-
One parent experiences a significant
change in income
-
Remarriage of one parent
-
The financial needs of the child
change
-
The child reaches the age of 18 or is
otherwise emancipated
We
will explain your legal options and the best
strategies for pursuing child support and
custody modifications such as the reduction of
child support payouts or change of visitation.
Your child's age may affect the alternatives
available in your case. For example, children
over the age of 12 have a say in which parent
should have primary custody.
Uncontested or Agreed Modification
Sometimes, after a period
of time has passed the parties want to modify
the child support or visitation decree. In
order for the modification to be uncontested the
parties must agree to all aspects of the
modification. In order for it to qualify
as uncontested for this offices flat fee the
following criteria must be met:
1.
Both ex-spouses (parties) agree to the
modification;
2. Both
ex-spouses agree on ALL issues;
3.
Your ex-spouse is not represented by an
attorney; and
4.
Both parties must voluntarily sign all papers
without requiring
service on any party.
If you would like our
office to represent you in an uncontested Child
Support or Custody Modification and you
meet the qualifications above, please mail, fax,
or e-mail the completed, signed client
questionnaire and Flat Fee agreement to our
office along with your cashier’s check,
certified check, money order, personal check, or
credit card authorization in the amount of your
total fees.
Contested Modification
Sometimes one party seeks
a modification of a final divorce decree or
child support order. In any instance where
the parties are not in agreement on all the
issues, the matter is contested. These
matters may settle quickly with the assistance
of the attorneys and possibly a mediator, or
they can drag out and be highly contentious.
It is advisable to consider all of the legal,
emotional and financial ramifications of these
actions Whether you are opposing or
seeking a modification you should consult and
consider hiring a child support attorney and
custody lawyer. Melissa E. Palmer can help
you evaluate the issues and your options so that
you can make the best possible decision for your
family.
